ACA Penalty Letters are Happening.
Summary: As of November, the IRS began sending penalty letters to over 100,000 ALEs who the IRS believes have failed to comply with the MEC requirements of the employer mandate under ACA for the 2015 filing year. They are too costly to ignore, and employers only have 30-days to respond.

IRS Delays Some ACA Reporting
Summary: The IRS has determined that a substantial number of employers, insurers, and other coverage providers may need additional time to prepare 2016 Forms 1095-B and 1095-C. As a result, the deadline for furnishing this information (to individuals) has been extended from January 31, 2017 to March 2, 2017. This guidance does not extend the time frame for submitting 2016 forms to the IRS.

Department of Labor Federal Civil Penalties Inflation Adjustment Act Catch-Up Adjustments.
Summary: The U.S. Department of Labor is issuing this interim final rule to adjust the amounts of civil penalties assessed or enforced in its regulations. The Federal Civil Penalties Inflation Adjustment Act of 1990 as amended by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 requires agencies to adjust the levels
of civil monetary penalties with an initial catch-up adjustment, followed by annual adjustments for inflation. The Department must publish the interim final rule by July 1, 2016 and the new penalty levels are effective no later than August 1, 2016.

Plan Administrator Must Pay Over $300,000 for Misrepresenting Level of Life Insurance Coverage
Summary: After receiving a smaller-than-expected payout on a life insurance claim, the beneficiaries sued their deceased daughter's former employer for breach of fiduciary duty, asserting that, as plan administrator, it misrepresented the amount of life insurance coverage in effect.

Department of Labor Issues Proposal to Modernize and Improve Form 5500 Annual Report
Summary: Proposed revision are intended to modernize the financial statements and investment information filed about employee benefit plans, update the reporting requirements for service provider fee and expense information, enhance accessibility and usability of data filed on the forms, require reporting by all group health plans covered by Title I of ERISA and improve compliance under ERISA and the Internal Revenue Code through new questions regarding plan operations, service provider relationships and financial management of the plan.

Pending Legislation Would Do Away with "Letter of Medical Necessity" Requirement

Summary: In early July, the House of Representatives passed the Restoring Access to Medication Act (H.R.1270), which would overturn a provision of the ACA and restore the ability to plan participants to use FSAs, HRAs, and HSAs funds to purchase over-the-counter drugs and medicines. The bill is now headed to the Senate for further consideration.

ACA Penalties to Hit $228 Billion

Summary: It is estimated that employer responsibility penalties will see a staggering $228 billion net from from 2017 to 2026, providing the Affordable Care Act remains in effect. While it's still marginally less than earlier projections, it does turn the spotlight onto employers who can avoid overspending on penalties by ensuring ACA compliance.
